By accessing or using this website and/or booking a session with Holly Shoots, you agree to be bound by the following Terms of Service (“Terms”). If you do not agree with these Terms, please do not use this site or engage Holly Shoots for services.

1. Overview

Holly Shoots is a professional photography service offering portrait, lifestyle, event, and other photographic sessions. These Terms govern all use of this website and all content, services, and products available at or through the site.

2. Session Booking and Payment

  • A non-refundable retainer (deposit) is required to reserve your session date and time.
  • The remaining balance is due on or before the date of the session unless otherwise specified in your contract or invoice.
  • Payment methods accepted include [list options, e.g., PayPal, Venmo, Stripe, etc.].

Cancellations:

  • Sessions may be rescheduled once without penalty if done with at least 48 hours’ notice.
  • Retainers are non-refundable under any circumstances unless canceled by Holly Shoots.

3. Session Expectations and Responsibilities

Clients agree to:

  • Arrive on time and prepared for the session.
  • Communicate any preferences, requests, or needs prior to the session.
  • Secure permissions to photograph at a chosen location, if required.

Holly Shoots reserves the right to terminate a session due to inappropriate behavior, unsafe conditions, or lack of cooperation, with no refund issued.

4. Photo Delivery and Editing

  • Edited photos are delivered via an online gallery within the timeframe outlined at booking (typically within 2–4 weeks).
  • Holly Shoots selects the final images delivered; raw or unedited images are not provided.
  • Minor retouching is included; additional or extensive editing may incur additional charges.

5. Client Usage Rights

Clients are granted personal-use rights only. This means you may:

✅ Share photos on social media (with credit where possible).
✅ Print and display images for personal use.
🚫 You may not edit, filter, alter, sell, or distribute the images commercially.

For any commercial, promotional, or editorial use, a separate licensing agreement must be established with Holly Shoots.

6. Photographer’s Rights & Copyright

All photographs taken by Holly Shoots are the intellectual property of Holly Shoots and are protected under U.S. copyright law (Title 17, U.S. Code).

Copyright Notice:
All images are the sole property of Holly Shoots and may not be reproduced, altered, or distributed without express written permission. Holly Shoots retains full copyright and moral rights to all images created, including but not limited to:

  • Portfolio use (website, social media, blog)
  • Marketing and advertising materials
  • Competitions and publications

If you would like your session to remain completely private, you must submit this request in writing prior to your session.

7. Model Release

By engaging Holly Shoots for services, you grant permission to use photographs in which you (and/or your children or guests) appear for portfolio, advertising, promotional, and educational purposes—unless otherwise stated in a signed release agreement.

You may revoke this release by providing written notice before or during your session.

8. Website Use

By using this website, you agree not to:

  • Copy or reuse any content or images from https://hollyshoots.org without written permission.
  • Misuse or interfere with the site’s features, services, or security.
  • Use the site for illegal or harmful activities.

9. Limitation of Liability

While Holly Shoots takes great care to ensure a smooth and professional experience, she is not liable for:

  • Unexpected weather or uncontrollable events affecting a session
  • Missed moments due to client lateness or uncooperativeness
  • Damage or loss of files due to technical failure beyond reasonable control

In the rare case of total photographic failure or equipment malfunction, liability is limited to the return of all payments received.

10. Indemnification

You agree to indemnify and hold harmless Holly Shoots from any and all claims, liabilities, damages, costs, or expenses (including legal fees) arising out of your misuse of services or violation of these Terms.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the state of Colorado, without regard to its conflict of law provisions. Any disputes arising under these Terms will be subject to the jurisdiction of the courts in El Paso County, Colorado.

12. Changes to These Terms

Holly Shoots reserves the right to update or modify these Terms of Service at any time. Updates will be posted to this page with a revised effective date. Your continued use of the site or services after changes are posted constitutes your acceptance of the updated Terms.
